The Procurement Act No. 7 of 2011 established the Eswatini Public Procurement Regulatory Agency (ESPPRA) as an independent regulatory body. The Act empowers the ESPPRA or the “Agency” with responsibility for policy formulation, regulation, oversight, capacity building and professional development, information management and dissemination in the field of public procurement in the Kingdom of Eswatini.

Establishment
The Eswatini Public Procurement Regulatory Agency (ESPPRA or “the Agency”), was officially established on the 27th May 2013, following the coming into force of the Public Procurement Act No. 7 of 2011 (the Act). It is listed as a Category A public enterprise, administratively, reporting to the Ministry of Finance.

Section 13 of the Procurement Act, 2011 establishes the Board of Directors of the Agency. The Board of Directors of the Agency are composed of a non-executive Chairperson, four non-executive members, and the Executive Director of the Agency who is an ex officio member. At least two of the Board of Directors shall be from the private sector, civil society or professional bodies, who shall be appointed by the Minister in consultation with the Cabinet, from among persons of good standing and recognised for their high levels of professional competence and integrity.

Office of the CEO
- Description:
The Chief Executive of the Eswatini Public Procurement Regulatory Agency assumes overall responsibility for the successful implementation of the ESPPRA policies and programmes, development of the ESPPRA Strategic partnerships and corporate relations as well as ensuring the ESPPRA sustainability.
Core Functions;
- Development of sustainable procurement strategies and implementation of actions that will result in the modernization of Public Sector Procurement in Eswatini with a view to making it efficient and effective.
- Building and maintenance of a strong multi-disciplinary management team to deliver value for money in terms of responsiveness, reliability and overall cost benefit, without loss of quality while adhering to the new Procurement Act.
- Ensure Government policies including private sector initiatives, public sector reforms, and anti-corruption measures are extended to public procurement.
- Assist the Agency to accomplish its objectives by bringing a systematic, disciplined approach to the evaluation and improvement of the effectiveness of risk management, control, and governance processes.
- Act as a consultant on various systems that are currently being developed by advising on the necessary controls required and on the strengthening of those already identified by the Executive Committee and the Board.
- Ensure that the Agency processes are in place to mitigate against any risk that may negatively impact on the achievement of its mandate as per the Public Procurement Act of 2011 and all relevant policies.

Finance & Administration
- Description:
Core functions;
- Being responsible for all Finance and Administration related matters of the Agency including the day-to-day management and administration and providing administrative support to all Directorates of the Agency.
- Managing the funds of the agency in accordance with section 20 of the Act.
- Preparing and submitting to the Board for its approval, a Management Plan, including a budget, setting out its objectives and planned activities for the next year.
- Preparing and submitting to the Board for approval any estimates supplementary to the budget of the current financial year.
- Ensuring that expenditures of the Agency are made out of the funds of the Agency in accordance with approved budget or supplementary estimates

Information and Communication Technologies (ICT)
- Description:
Core functions;
- Promoting introduction and use of Information and Communication Technology (ICT) in public procurement by procuring entities.
- Examining and recommending ways of introducing in public procurement, the use of ICT and other technical innovations, where such technology promotes the objectives of the Act.
- Making recommendations to the Directorate of Procurement Policy for issuing circulars and instructions on measures and programs to introduce the use of ICT in public procurement.
- Identifying any required additions or amendments to the legal and regulatory framework for public procurement to support the application of ICT and making recommendations to the Directorate of Procurement Policy in this regard.

Procurement Monitoring and Oversight
- Description:
Core functions;
- Maintaining a list of procuring entities, procurement officers and list of members of tender committees.
- Monitoring procurement performance of procuring entities and compliance with the provisions of the Act and the Regulations issued under the Act.
- Exercising the competence, authority, power and responsibility of the Agency for enforcement of the provisions of the Act and the Regulations, through:
- Monitoring and evaluation progress made in the implementation of procurement reform.
- Monitoring and evaluation procedures regularly, and preparing detailed reports on financial savings on procurement.
- Establishing guidelines in collaboration with the Internal Audit Agency on systems and procedures for procurement auditing and inspecting records of procurement entities.

Procurement Capacity Building
- Description:
Core functions;
- Planning and drawing up of strategy for capacity building, to support and strengthen the public procurement system
- Assessing training needs required for the public procurement system and delivering programmes to deal with shortcomings
- Establishing standards and performance criteria required at each level of operation.
- Identifying institutions that would provide formal programmes for academic qualifications to meet professional standards required at all levels of operation.
- Designing and implementing procurement training programmes suitable for other professionals associated with the procurement function.
- Liaising with Office of Head of the Civil Service and other relevant public institutions for career structure in the public service for procurement professionals.

Procurement Policy, Legislation and Investigation
- Description:
Core functions;
- Advising the Government and procuring entities on procurement policy.
- Reporting on the performance and functioning of the public procurement system and recommending changes.
- Formulating regulations governing the procurement of goods, works and services for the Government and recommending these to the Minister for issue in accordance with section 65(1) of the Act.
- Issuing public procurement manuals, circulars and instructions in accordance with section 66 of the Act to provide further guidance on the interpretation and application of the Act and public procurement regulations issued under the Act.
